Unfortunately, the company probably has an official policy of "3 warnings and you're out," and won't fire without documenting the 3 warning letters first.  Which, not to worry, will happen in short order.

At-will employees CAN sue for wrongful termination if the company isn't following its own procedures for firings.  They may not win the lawsuit, but it's not going to be dismissed outright.

Personally I would have expedited the process by making the Sept. 12 and 14 events the first warning, and the Oct. 9 and 16 events the second warning.  Maybe treat the change to the company website photo as hacking and make it into the "this is the third offense, pretty serious one, you're out."
