MALONE, N.Y. -- An inmate with close to 100 violations since entering prison has been charged with throwing a cup of urine on a corrections officer.
Henry Benitez, 43, of Brooklyn, was charged with assault on staff and committing an unhygienic act, a spokeswoman for the Upstate Correctional Facility in Malone said.
This is the third time in four years Benitez has been charged with throwing bodily fluids, which is a felony.
Benitez could see another five years in prison, but he's already serving almost 105 years to life for burglary, robbery and sex crimes.
Throwing urine is becoming less common in New York, the Plattsburgh Press-Republican reported. Since being classified a felony, incidents have dropped from 130 in 1995 to 21 in 2004.
Malone is about 40 miles west of Plattsburgh.
