How the hell does that get past a 12(b)(6) motion, let alone a summary judgment and to trial?

Two updates. The guy broke down in tears describing the horrible anguish caused to him by this pair of pants being temporally misplaced. He only "needs" 2.5 million to cover his pants trauma. He is hoping the rest will be used as an incentive for other lawyers to follow his heroic lead. I shit you not. The judge was apparently trying to stifle her laughter at that one. The article says the tie he was wearing during his testimony was stained so I guess the Heinz ketchup company had better watch its back. Verdict should be in by next week.

The saddest fact of this whole thing is the guy suing is a frickin judge.
And the dry cleaners offered him $12000 to cover replacement years ago and he refused.
I bet the damn pants are in his closet.

I really hope the judge not only tosses the case but she awards the defendants a $64 millon judgement.

The funniest part of that is this quote: Bork argued that frivolous claims and excessive punitive damage awards have caused the Constitution to evolve into a document which would allow Congress to enact tort reforms that would have been unconstitutional at the framing Captain Originalism suddenly thinks the Constitution can "evolve" as long it is in a direction he wants. Shocking.

I guess what the judge presiding over the case does next week determines exactly who gets to be the douchebag.

Pants guy loses, has to pay drycleaners $1000 in legal costs and might have to pay much more for their legal bills later.

Hell, he sued them for 1 pair of missing pants. Attorney's fees. They could also file a complaint with state's attorney disciplinary board. Those guys also deal with judges in some states. Filing a frivolous or malicious lawsuit is generally not kosher by most ethical standards.

I traded in my fun blog for several legal blogs. Or, "blawgs," as the cutesy attorney blawgosphere likes to call 'em.

There are a couple of organizations trying to get him disbarred. I think they waited until the case was done before they really started the ball rolling.

Were they at least NICE pants? I really don't get how this even got to court. Wouldn't a normal, sane judge just dismiss the case?

They were a pair of your normal 100 dollar dress pants that go with a suit. Nothing fancy. The cleaners offered to pay 1200 bucks for a replacement pair when he claimed the ones they found (which were most certainly his at this point) were someone elses. I think the sane judge let this come to court so the public could see how much of a douchebag this guy was becuase it was ultimately thrown out.

Actually, a lot of grey suits have red and blue stripes. As Straz mentions, they are very subtle.
