Looks like a pretty solid jaw dislocation to me.  It was probably hanging open after that - either that or on the floor.  I've had drawn the arrow on the guy on the top, rightish.  Smug expression like he planned the thing.

How does the dude not even have his hands up? Was he not paying attention to the playing field?

I also don't get the "lottery ticket" reference as there is no (or at least highly limited) liability under the "baseball rule" of assumption of risk.

Oh, I know black letter tort law.  Its just that MLB will probably find it easier to pay the guy's expenses and throw a few thousand at him than to litigate (even though summary would probably get rid of it).  Besides, its arguable that while "ball" is an accepted risk at the game, "bat" isn't.  I doubt it would be decided under baseball assumption if the guy had hot popcorn oil poured on him by a moving vendor, for example.

I don't get the dad leaning back not protecting the aforementioned toddler.   My first instinct is always to pull the kids under/ behind me, not lean back and hope just my hands are sufficient.

I'm pretty sure the bat came from straight into the picture slightly from the right side, not from the left.  Grandma was on the job of shielding the kiddy.  The unfortunate victum should have been watching the game instead of wondering what the people to his left were so upset about.

Nope. Bats are covered too, even in New Jersey with their lightened rule, if you are sitting in the stands. Covers all objects leaving the field.  Knowing how these parks work the guy won't get a dime either. He likely will get some signed stuff from the guy who didn't put enough pine tar on his stick though.

Actually, as odd as it is, that's my mother's friend Craig. He didn't even know that picture was taken until someone else showed him. And as far as damage goes, I think all he got was a pretty bruised jaw. It's a semi-old picture, but I know he's 100% now.
