On the one hand, I favor IP law in the case of Calvin and Hobbes. Bill Watterson had every right to say "no" to putting Hobbes on lunchboxes and Calvin on boxer shorts.

On the other hand, I hate it when corporations go on witch hunts after fan works that are "hurting their franchise". Gimme a fucking break. Like Sly said, there's no tangible evidence for it, and it's reactionary bullshit.

The way IP law is written, if they don't then they can potentially lose their rights to it.  The laws are enough of a mess that some companies simply will not take that risk.

Well, per our IRL conversation, I'm sure it HAS happened before, otherwise it wouldn't be an honest concern for companies trying to protect their IP. Really, I'm sick of people saying "it's reactionary bullshit" without knowing all the facts, which I'm trying to find.

Sadly, if you google "company loses money bad fan work" or anything like it, you get fan fic of Picard and Kirk running a business and losing money.

This is another elusive thingie. Who really lost their rights because they didn't protect their property sufficiently? I want case studies god fucking dammit. This should be EASY to find.

I'm not a lawyer, so I'm not equipped to go looking for cases.  I know it's happened lots of times with patents and that's a pretty cut-and-dried "who invented it first" thing in comparison.

Even if it has never happened, a company like Square-Enix is not going to risk being the first.  They're not interested in being a test case.  Nor are most other major IP holders.
