Speaking of, what the fuck? The dead can't give consent? There's lots of reasons to vote against necrophilia, like - it's sick, sick, sick, sick. But their logic? Total backwards retarded political shit logic. Just dumb. Dumb as nails.

I started typing out a post in reply to this. I then realized I was discussing necrophilia in some detail in an attempt to make a point explaining that it's wrong.

Why am I even in this thread.

It's certainly disgusting, but to play devil's advocate, I don't think there's anything illegal about the act itself. I think the problem is that you're likely digging up someone (trespassing) whose relatives would object (theft).

I suppose if you could obtain permission from next-of-kin, it could be permissible.

Though it would still be disgusting.

A lot of people are reading this story wrong. Nobody has voted for or against necrophilia, the Wisconsin High Court has just ruled whether or not current Wisconsin law makes it illegal. Not whether it *should* be illegal but whether it actually is. The judges who ruled that it wasn't illegal weren't (presumably) saying htat necrophilia was a cool thing to do but that in their opinion it wasn't specifically illegal under existing law. Those who ruled that it was illegal used the consent issue as the basis for that opinion. There are other, better reasons to make it illegal but none of those reasons appear to be enshrined in Wisconsin law at the moment.

From what I remember of reading about "Ressurection Men" theft of corpses isn't illegal in a majority of states, either.  Want to go dig a body to sell it off for parts or to Medical schools? Go for it. Most they can get you for is trespass.  Well, that WAS the case at least, as more and more corpses are being stolen or scavenged for transplant parts, more states are passing laws about the sale and theft of necrotic tissues.

There aren't a lot of laws covering the dead, really.  Probably because we don't want to think about where we're all headed.. lawmakers much sooner than the rest of us Oh ho ho ho. Reallllly?  The lack of necrophilia laws I just pass off as people figuring "that's not really a problem, who the fuck would have sex with the dead?"

Yes.  Also, for whoever mentioned it, the penalty for necrophilia is nowhere near the penalty for rape.  From a constitutional standpoint, I seriously doubt you could equalize the punishments. 

EDIT:  Although I suppose you could get charged with attempted rape if the government could prove you didn't know they were dead.
