The RIAA doesn't want to play.    Start saving those films now because you won't see them anywhere within the next few hours, I suspect.  While not killing FRAPs vids entirely, it does mean they're going to be a lot less interesting.  Yeah, you can still make them, just sans music or using only public domain works.. which still gets tricky because the RIAA has managed to get specific performances covered, even if the song is public domain. i.e. The London Symphony playing Beethoven's 5th.

What else could they do?  Clearly rpgfilms.net was driving them to financial ruin.  A clear-cut case of self defense if I ever saw one.

Unfortunate but not unexpected. It's also unfortunate for those artists whose music were included on those videos. I've bought a few CDs (e.g. Chevelle and Green Day) I may not have otherwise bought just from hearing their songs on various videos.

My hope is that one of the biggies realizes that these sorts of things are essentially free advertising for multiple products on top of a kind of viral marketing, and just decides to tell the RIAA to go fuck themselves with thumbtack-encrusted dildos.

Copyright infringement is copyright infringement. Doesn't matter if it's an ice cream truck, a school playing a VHS tape, or some video game recording that some 12 year old added a Metallica song to.

If they were hosting the files they don't have a leg to stand on. The videos with infringing music will still get made just don't try to store them all in a central location. Why do you think P2P came about?

It's not fair use. They received a DMCA notice because they were a central location. They may have been making money from banner ads but making money from it isn't a deciding factor. The term "financial gain" includes receipt, or expectation of receipt, of anything of value, including the receipt of other copyrighted works.

Basically you can send a DMCA notice for anything you want (you can even lie or be blatantly wrong). There is no penalty for sending a bogus one.

I'd say if they were hosting 600 movies that had copyrighted music in them they would be facing 3 years in prison if the govt. chose to go after them. The govt. hardly ever uses the NET Act though.

The RIAA doesn't really have any clients. The board members of the RIAA for profit corporation are the CEOs and other high mucky mucks from the 4 major record labels. It's basically a front to keep the major record labels from running afoul of antitrust laws, pretend they are a govt. organization, take all the heat from lobbying/enforcement, and keep the corporate owner's brand names clean. The head of the IFPI which is the international RIAA use to be the head of the RIAA.

The RIAA doesn't sue you because it doesn't hold any copyrights. The record label corporations sue you.
