Its just that MLB will probably find it easier to pay the guy's expenses and throw a few thousand at him than to litigate (even though summary would probably get rid of it). Besides, its arguable that while "ball" is an accepted risk at the game, "bat" isn't. Grandma was on the job of shielding the kiddy. The unfortunate victum should have been watching the game instead of wondering what the people to his left were so upset about.

Bats are covered too, even in New Jersey with their lightened rule, if you are sitting in the stands. Covers all objects leaving the field.
