I think the problem is that you're likely digging up someone (trespassing) whose relatives would object (theft).

Nobody has voted for or against necrophilia, the Wisconsin High Court has just ruled whether or not current Wisconsin law makes it illegal. Not whether it *should* be illegal but whether it actually is. The judges who ruled that it wasn't illegal weren't (presumably) saying htat necrophilia was a cool thing to do but that in their opinion it wasn't specifically illegal under existing law. Those who ruled that it was illegal used the consent issue as the basis for that opinion. There are other, better reasons to make it illegal but none of those reasons appear to be enshrined in Wisconsin law at the moment.

Go for it. Most they can get you for is trespass. Well, that WAS the case at least, as more and more corpses are being stolen or scavenged for transplant parts, more states are passing laws about the sale and theft of necrotic tissues. There aren't a lot of laws covering the dead, really. Also, for whoever mentioned it, the penalty for necrophilia is nowhere near the penalty for rape. From a constitutional standpoint, I seriously doubt you could equalize the punishments. EDIT: Although I suppose you could get charged with attempted rape if the government could prove you didn't know they were dead.
