Ian McKellen Has been pretty accommodating of his geek fans.  I don't think he'd get pissed off over someone shopping his photo.  Although he no longer has a public email address (he got swarmed after the fanboys found out he answered his own email), you could always send him a tweet and ask.

Actually, the more I think on this;  Every time I've seen this picture on the web (and it's been lots) it's immediately followed by 'That's a shop, here's the real pic of him' showing the slogan.

I think that the shop has got him more publicity on the actual issue of gay rights.  I don't think he'd mind that at all.  His popularity with the geeks is another way to get his message out.
